SHIPPING POLICY

This Shipping Policy is incorporated into and made part of The New CAPITAList LLC (dba Mr Nice Ky) Terms and Conditions of Sale. By placing an order, Buyer agrees to the terms set forth below.

1. Shipping Destinations

The New CAPITAList LLC (dba Mr Nice Ky) ships only within the United States of America. We do not ship internationally. We do not ship to any jurisdiction where the sale or possession of our products is prohibited by law.

2. Prohibited & Restricted Jurisdictions

We are unable to ship to the following states and localities (list is not exhaustive and is subject to change):

States: Alabama, Arkansas, Connecticut, Indiana, Kansas, Louisiana, Tennessee, Vermont, Wisconsin.

Counties / Cities: Sarasota County (Florida), San Diego County (California), Oceanside (California), Alton (Illinois), Jerseyville (Illinois), Edwardsville (Illinois), Columbus (Mississippi), Union County (Mississippi).

Buyer is solely responsible for verifying that the shipping destination is legal. The New CAPITAList LLC (dba Mr Nice Ky) reserves the right to cancel any order destined for a prohibited jurisdiction without notice.

3. Processing & Shipping Times

Orders are generally processed and shipped within 1-2 business days from receipt of payment (Monday-Friday, excluding holidays). We make no guarantees regarding exact processing or delivery times. Delivery estimates are provided for convenience only and are subject to delays caused by the carrier, weather, holidays, or other factors beyond our control.

4. Shipping Methods & Costs

$12 flat-rate shipping is available on most items. All orders include tracking. The New CAPITAList LLC (dba Mr Nice Ky) reserves the right to select the shipping carrier and method. Expedited shipping options may be available at additional cost during checkout. All orders with a sub-total of $200 or more (not including shipping fees) will automatically require an adult signature (21 years or older) and ID verification at the point of delivery. You may opt out of the adult signature requirement, but the buyer then waives all rights to refunds or replacements if a shipment is not delivered or is delivered and lost or stolen.

5. Packaging & Discretion

All orders are shipped in plain, discreet packaging with no external branding or product identification. Items are securely packaged to protect product integrity during transit. Real-time tracking is provided on every order.

6. Risk of Loss & Delivery

Risk of loss passes to Buyer upon tender of the package to the shipping carrier. The New CAPITAList LLC (dba Mr Nice Ky) is not responsible for lost, stolen, or damaged packages once they have been handed to the carrier. Delivery confirmation by the carrier constitutes proof of delivery.

7. Address Changes & Special Requests

Address changes must be requested before the order ships. We cannot guarantee changes after an order has entered the fulfillment process. Special delivery instructions in the order notes are not binding; we cannot ship to alternate addresses listed only in notes.

8. International Shipping

We do not ship outside the United States. Any order with an international shipping address will be cancelled.

9. Returns & Refunds

Returns and refunds are governed by our separate Return & Refund Policy. Please refer to that document for details regarding eligibility, timeframes, and conditions.

10. Entire Agreement & Governing Law

This Shipping Policy is part of The New CAPITAList LLC (dba Mr Nice Ky) Terms and Conditions of Sale and is governed by the laws of the State of Oregon. Any disputes arising under this policy shall be resolved in accordance with the dispute resolution provisions in the Terms and Conditions.

By placing an order, you acknowledge that you have read, understood, and agree to this Shipping Policy in its entirety.
